Fair use in Rachel Corrie
I (Martin 18:37, 24 Oct 2003 (UTC)) believe that the image linked here is under fair use as:
- It is a historically accurate photo. The act depicted has been deemed important by the Anti-Defamation League (ADL) and other commentators on the Israeli-Palestinian conflict.
- The original author is not known, but credit is given to the location Wikipedia obtained it from - the International Solidarity Movement.
- It is presumed to be of much lower resolution than the original photograph (copies made from it will be of very inferior quality) and is used as a thumbnail in the article itself - smaller still.
- It is necessary to meet the Wikipedia requirements of a "neutral point of view": the neutrality of reports that do not include this image has been questioned by the ADL and other commentators.
- The photo was widely reproduced both by websites and by other means. Wikipedia's redistribution has no significant additional effect on the market or potential market for the work.
- A good faith attempt (which failed) to trace the copyright owner and obtain explicit permission has been made: see Talk:Images of Rachel Corrie.
